Terms of use

1. Acceptance

By creating an account or using HeyAmigo, the app and this website, you accept these terms. If you do not accept them, do not use HeyAmigo. HeyAmigo is operated by {{ENTITY_NAME}}, {{ENTITY_ADDRESS}}, {{ENTITY_COUNTRY}}, registration number {{ENTITY_REG_NO}}.

2. Who can use HeyAmigo

You must be at least 16 years old. When you sign up, whether with email, Google or Apple, we ask for your date of birth and you confirm that it is true. People under 16 are refused and cannot use HeyAmigo.

3. Your account

You sign in with Google, email or, on iPhone and iPad, Apple. Keep your sign-in details safe and do not share your account. You are responsible for what happens under your account. You can delete it at any time from the app.

4. Licence and restrictions

We give you a personal, non-exclusive, non-transferable and revocable licence to use the app for your own use. You may not:

• copy, modify, reverse engineer or resell the app;
• use bots, scrapers or other automated means to access HeyAmigo;
• try to bypass the limits of your plan or the security of the service.

5. The Amigo AI assistant

Amigo’s replies are generated by an OpenAI model. They can be incomplete, out of date or incorrect. HeyAmigo is not an official office and is not affiliated with any Swiss authority. Confirm important procedures with the official office before you act, and decide for yourself what to do.

To use the chat you must first agree to send OpenAI your messages, attachments, voice notes, profile details and agenda events, including events imported from Google Calendar, as explained in the privacy policy. You can withdraw that permission at any time in Profile. Every reply is labelled “AI-generated”, and you can report a reply from the app.

6. Your content

You keep the rights to what you write and upload. You give us the permission we need to store it and show it back to you, and, once you have agreed, to send it to OpenAI to produce replies: your messages, attachments, voice notes, profile details and agenda events, including events imported from Google Calendar. We may keep your questions and Amigo’s answers without a link to your account to improve our knowledge base, after our team has reviewed them, and our staff may read conversations and AI logs for support and safety, as the privacy policy explains. Do not upload content that you have no right to share or that is unlawful. Removing the account link does not remove names or other personal details inside questions, answers or report notes. This text is not automatically anonymized and may still identify you or someone else.

7. Plans and subscriptions

HeyAmigo has a free plan and paid plans. When available, paid subscriptions are purchased through the Apple App Store or Google Play. The store price, billing period and what each plan includes are shown in the app before you buy.

• A subscription renews automatically at the billing period shown before purchase until you cancel it.
• You cancel in the subscription settings of App Store or Google Play, before the renewal date. Deleting your account or the app does not cancel it.
• Refunds for purchases made on the App Store are decided by Apple. You can request one at reportaproblem.apple.com.
• Purchases made on Google Play can be refunded by Google within its refund window. You can also write to [email protected] and we will review your request.
• The features and limits of each plan are shown in the app. Use Restore purchases in the Plan screen to ask the store to recover an existing purchase, using the store account that bought it. Restore does not buy a new subscription, cancel renewal or request a refund. Access in HeyAmigo also depends on the purchase being linked to your signed-in account and confirmed by our service. Use Manage subscription in Profile to open store subscription settings.

8. Acceptable use

You agree to use HeyAmigo lawfully and with respect for others. You must not:

• break the law or the rights of others;
• harass, threaten or deceive anyone;
• upload malware or content meant to harm the service;
• use Amigo to produce harmful or unlawful content.

9. Disclaimers

HeyAmigo is provided “as is” and “as available”. Information in the app can be incomplete or out of date, and we do not promise that the service will always be available or free of errors.

10. Limitation of liability

As far as the law allows, we are not liable for indirect or consequential loss, or for decisions you take based on Amigo’s replies. Nothing in these terms limits liability that the law does not allow us to limit, including for intent or gross negligence, or your rights as a consumer.

11. Termination

You can stop using HeyAmigo at any time and delete your account. We may suspend or end your access if you break these terms or to protect the service or other people. Where we can, we will tell you first.

12. Changes to these terms

We may update these terms. We will publish the new version here with its date and, for a significant change, tell you in the app. If you keep using HeyAmigo after the change, you accept the new terms.

13. Governing law and jurisdiction

These terms are governed by the laws of the country where {{ENTITY_NAME}} has its registered office, {{ENTITY_COUNTRY}}. The courts of {{ENTITY_COUNTRY}} have jurisdiction, unless mandatory consumer protection rules give you the right to go to the courts of the place where you live.
